General Terms and Conditions of Simo and Family Ltd. online shop

Subject of the contract

The Merchant shall provide the User with the opportunity to purchase food products and services produced by Simo & Familia Ltd. through online ordering and delivery to a specified address.

2. Prices and payment

All prices in the online shop are final, in Bulgarian levs (BGN) and inclusive of VAT, if applicable.

Payment can be made in the following ways:

- By bank card via Stripe's secure system, which processes the payment on behalf of the Merchant. The Merchant does not collect or store your bank card details. - Cash on delivery (cash on delivery) - made directly to the courier upon receipt of the order.

3. Order

To place an order, you need to provide valid delivery and contact details.

After finalizing the order, you will receive a confirmation email.

The merchant reserves the right to refuse an order in case of out of stock or other objective reasons, notifying the customer in advance.

4. Delivery

Delivery is made by courier company to the address specified by the customer.

The delivery terms and prices shall be specified before the order is completed.

In case of delay due to the fault of the courier, the Merchant is not liable.

5. Right of withdrawal (return of goods)

The user has the right to cancel the order within 14 days from the date of receipt of the goods.

The cancellation can only be exercised if:

- the goods do not fall within the exceptions under Art. 57 of the CPA (e.g. perishable food); - the product is in commercial condition, without damaged packaging and has not been used.

To exercise the right of withdrawal, the User must notify us in writing by email, including the order number and return details.

The cost of the return will be borne by the User.

Refunds will be made within 14 days of receipt of the returned product.

6. Refusal of return for perishable food

Pursuant to Article 57(4) of the PPA, goods that may deteriorate or have a short shelf life (e.g. fresh or chilled food) are not returnable.

In such a case, the right of withdrawal does not apply.

7. Complaints

In the event of a damaged or defective product, the Consumer has the right to make a claim pursuant to Art. 122 et seq. of the Consumer Protection Act.

The complaint shall be submitted in writing, with photographs, within 48 hours of receipt of the goods.

8. Personal data

We collect and process personal data in accordance with our Privacy Policy. The user consents to the processing of his/her personal data for the purposes of order fulfilment, communication and newsletter sending, subject to express consent.

9. Copyright

All content on the website (texts, images, logo, trademark) is the property of Simo & Familia Ltd and is protected by copyright.

10. Applicable law

These Terms and Conditions shall be governed by the laws of the Republic of Bulgaria. Disputes arising shall be settled by negotiation or, if necessary, by the competent court.
